What To Expect

During your routine seasonal services, your Pest Pro will inspect and treat the exterior of the home to prevent general pest issues. They will treat for 30+ crawling insects, rodents, spiders, and stinging pests. If you have termite protection, we will inspect for signs of termites and maintain your Sentricon termite system. For clients with mosquito & tick control, we will target foliage and areas with standing water on a monthly basis April-October.

What if I am not home for a treatment or missed the technician?

Our exterior seasonal preventative treatment target pests before they get into your home. So there is no need to be home for most treatments as long as gates are unlocked. And, you're covered for interior services or pretreatments as needed at no additional cost.

Service Agreement

Service Agreement — My Pest Pros, LLC

In consideration for the payment(s) of the fees set forth below and subject to the terms and conditions of this service agreement ("Agreement") between MY PEST PROS, LLC ("MPP") and the above-named Client ("Client"), MPP will provide service to the above identified structure(s) ("Structure(s)"), located at the above Service Address, unless specified in writing on this Agreement, for the following termite(s) and/or pest(s) ("Serviced Pest").

PAYMENT TERMS

I, the Client, authorize MPP to charge for my services by credit card, ACH, or Bank Draft and understand that this payment information will be saved for future and reoccurring transactions on my account until I request cancellation of this authorization by calling or writing My Pest Pros.

I, the Client, understand that my payment will automatically be charged every month for ongoing protection. I, the Client, also understand that monthly billing does not indicate monthly service.

RENEWALS

The initial term of this Agreement is for one (1) year. This Agreement will renew automatically every thirty (30) days thereafter upon Client's timely payment of the Monthly Renewal Fee.

Service will continue unless a 30-day written notice of cancellation is given by either party.

Client's failure to pay the Monthly Renewal Fee in accordance with this Agreement will render this Agreement voidable at the election of MPP, but shall not relieve Client from the obligation and requirement to provide payment for all amounts due and owing pursuant to this Agreement.

GENERAL TERMS AND CONDITIONS

Depending on the plan selected, MPP and Client agree to the following Terms and Conditions:

One-Time Treatments

One-Time Treatments applies if the Client has elected for a one-time service only. A One-Time Treatment is a treatment without ongoing protection services. Client understands that MPP recommends recurring services because it provides the best protection and some services may require multiple applications to eliminate a pest issue. A One-Time Treatment includes no warranties unless specified in writing on this Agreement. An exception is stinging pests, which include a 30-day reservice warranty.

General Household Pest Service

If the Client has elected for General Household Pest Service, MPP will inspect and treat the interior of the Structure(s) up to four times per year, as needed or upon Client's request. Exterior perimeter treatment is limited to within 3 ft of the Structure and includes inspection for the serviced pests, spider web and wasp nest brushing.

Due to the nature of pest's ability to hide, reproduce quickly, and resist available pesticides, total eradication of the Serviced Pest may not be possible. Client understands that MPP is not guaranteeing that the Serviced Pest will be completely eradicated, rather, MPP will use its best efforts to control the Serviced Pest.

Additional Termite Protection

If the Client has elected for Additional Termite Protection, MPP will install, monitor, and service the Sentricon® AlwaysActive™ System in-ground termite baiting system at the Service Address for the control of Subterranean Termites. This Agreement only covers the Structure(s) specifically identified and does not cover detached garages, outbuildings, fences, decks or other buildings unless specified in writing.

Re-treatments with a liquid termiticide may be necessary during the period of this Agreement and will be provided at no additional cost to the Client should a reinfestation of Subterranean Termites occur.

Mosquito and Tick Seasonal Service

If the Client has elected for Mosquito and Tick Seasonal Service, MPP will perform treatments including barrier sprays to the infested service area to control mosquitoes and ticks. Client understands that mosquitoes are flying insects and can fly from nearby properties. Services will result in reduction of mosquito activity; however, there is no guarantee of 100 percent elimination.

During the months of April through October, MPP will provide, free of charge, follow-up service at Client's request in between regular paid services, provided Client is current on each monthly payment.

Rodent Control and Exclusion

If the Client has elected for Rodent Control and Exclusion Service, MPP will inspect and treat the Structure(s) at the frequency selected. MPP exclusion service will seal small gaps 4 inches or less in size to help prevent rodent reentry. MPP's service excludes larger or more extensive gaps which require a handyman or contractor.

FOR ALL SERVICE AGREEMENTS

Scheduling

MPP will automatically schedule proactive pest control services, inspections and treatments. Routine proactive residential services will focus on exterior treatment to prevent pest issues on interior. Interior treatment shall be provided upon request when included in pest program.

Emergency Service

MPP's normal working hours are from 8:00 am to 5:00 pm, Monday through Friday. Emergency after-hours service will be charged at a minimum of $150 per incident in addition to normal service charges.

Access and Preparation

Client agrees to provide full access to the premises and designated Service Area(s) at the scheduled time of service. MPP does not move furniture, appliances, or personal property to provide treatment.

Chemical Sensitivity

If Client or an occupant of the Structure(s) knows, or believes, that he or she may be sensitive to pesticides or their odors, written notice must immediately be provided to MPP prior to any service.

Cancellation Policy

Service will continue unless a 30-day written notice of cancellation is given by either party. In the event of a price increase, Client may cancel this Agreement, without termination fee, by written notice to MPP within 30 days.

Price Increases

All prices may increase up to 5% annually. During any renewal term, MPP reserves the right to increase the Service Charges as warranted by increases in the cost of labor, materials, or overhead.

Binding Arbitration

Client and MPP agree that any and all controversies or claims arising out of or relating to this Agreement shall be settled solely and exclusively by arbitration administered under the American Arbitration Association ("AAA"). This arbitration provision shall survive cancellation, expiration, or termination of this Agreement.

Communication

Good communication is critical for service. Client understands that MPP may contact Client via phone, email, or text.

By signing this Agreement, Client hereby acknowledges that Client has read and fully understands all terms, disclaimers, limitations, conditions, and exclusions contained in this Agreement that affect MPP's obligations to service under the terms of this Agreement. Client specifically understands that MPP and Client are bound only by the terms of this Agreement and not by any other representation(s) whether oral, written, or otherwise.
